Adopted by Parliament: Prosecutors and judges in key positions will be subject to external evaluation
The ethical and financial integrity of judges and prosecutors holding key positions in the justice field will be subject to external review. In this sense, the deputies voted in the second reading of a draft law. According to the Parliament, the document represents the last stage of the external evaluation mechanism and one of the commitments assumed by the Republic of Moldova in the context of obtaining the status of a candidate country for accession to the European Union.
The legislative initiative includes details about the evaluation subjects, the institutions involved in this process, the evaluation procedure and criteria, the appeal procedure, etc. It should be noted that, in the process of assessing financial integrity, the assets and expenses related to the available income and declared by the subject, as well as the income and expenses of their family members, will be verified.
The evaluation of ethical and financial integrity will concern about 140 judges, about 220 prosecutors, as well as candidates for any vacant positions, who will win the contests until 2025.
Two six-member commissions will be created for the external evaluation of judges and prosecutors. After the evaluation, the commissions will draw up reports on the promotion or non-promotion of the subjects, which will be sent to the Superior Council of Magistrates and the Superior Council of Prosecutors. Moreover, a special panel will be established at the Supreme Court of Justice to examine the appeals.
