Moldova's Pre-Vetting Commission launches integrity assessment of CSP candidates

The Pre-Vetting Commission has launched the integrity assessment of two civil society representatives selected by the government to fill the vacant position of member of the Superior Council of Prosecutors (CSP). The candidates are Radu Mîrza, an expert in justice, the rule of law, and human rights, and Mihail Sorbalo, a university lecturer at the Public Law Department of the ULIM Faculty of Law.

The commission sent the candidates the Declaration for 5 Years form on Wednesday. The completed declaration, as well as any other additional documents as needed, must be returned to the commission by email by the end of September 20, 2023.

After receiving the declarations, the Pre-Vetting Commission will analyse the income and assets of the candidates and their families, based on extensive research of relevant evaluation data collected from public information systems, accumulated from individuals and legal entities, and in subsequent communication with the candidates.

In order to provide advance notice, on September 6, 2023, the commission sent the candidates a completed example of the Declaration for 5 Years, to give them more time to collect the information needed to complete the document. Additionally, candidates were given the opportunity to complete the Ethical Integrity Questionnaire, which, unlike the Declaration for 5 Years, is voluntary.

The position of CSP member from the civil society, for which the two candidates are vying, became vacant in April 2023. According to the Law on the Prosecutor's Office, the CSP is composed of 10 members.

Five members of the CSP are elected by the General Assembly of Prosecutors from among serving prosecutors, one from the General Prosecutor's Office and four from the territorial and specialised prosecutors' offices, and four members are elected through a competition from among the civil society, as follows: one by the President of the Republic, one by Parliament, one by the Government, and one by the Academy of Sciences of Moldova. At the same time, the President of the Supreme Court of Justice (including acting) is a member of the CSP by right.
