Moldovan court rules against ban on unconstitutional parties in elections
The Constitutional Court of Moldova has ruled that article 16, paragraph (2), letter (e) of the Electoral Code, which prohibits the participation in elections of representatives of parties declared unconstitutional, is unconstitutional. Judges Nicolae Eșanu and Liuba Roșca filed dissenting opinions. The decision is final and cannot be appealed, enters into force on the date of its adoption, and is published in the "Official Gazette".
Last Monday, Parliament Speaker Igor Grosu said in an interview on PRO TV that the authorities have prepared several solutions if the Constitutional Court decides today to allow members of the unconstitutional Shor Party to participate in elections.
"This decision, regardless of what it is, will have an impact on the local elections, it will motivate or demotivate some electoral actors. We will continue to take all legal measures to prevent the bandits, who are the spearhead of the Russian Federation. I very much hope that the decision-makers, whoever they are, whether they are in Parliament, in the Government, or in other law enforcement institutions, understand the context and the danger to which the Republic of Moldova is exposed. We are not fighting these bandits, we are in an open confrontation with the Russian Federation, even the Kremlin no longer denies this. Therefore, when such hybrid-origin dangers pose a real threat to national security, I hope that those decision-makers will not ignore these things," the Speaker of Parliament said.
On September 28, the Constitutional Court suspended the provisions of the Electoral Code that prohibit members and elected representatives of unconstitutional parties from running for office. The Court specified that it suspended the provisions in question following a complaint filed by deputies of the former Shor Party.
In June, the Constitutional Court declared the Shor Party unconstitutional, and later the parliament voted for legislative amendments that prohibit people from the leadership of unconstitutional parties and those who hold elected office from running for office for a period of 5 years.
