Moldova MPs Challenge President Over Gagauzia Appointment
Five independent MPs have filed a complaint with the Constitutional Court, challenging President Maia Sandu's refusal to sign the decree appointing the leader of Gagauzia as a member of the Government.
Experts argue that the complaint filed by the MPs lacks merit, as it is the President's constitutional right to accept or reject this nomination.
Expert: President's Actions Within Her Rights
Nicholae Osmochescu, an expert in constitutional law, told Radio Moldova that the MPs' request for the Constitutional Court to verify the constitutionality of Maia Sandu's refusal is unfounded.
"The President can only be held accountable for laws passed by Parliament or Government actions," he said. "This is a Presidential decision, and the Court should reject the complaint."
Presidential Institution Remains Silent
The Presidential Institution has not yet commented on the complaint filed by the five independent MPs.
President's Previous Stance
President Sandu previously told Radio Moldova that she would not sign the decree appointing Gagauzia's leader Evghenia Guțul to the Government, alleging that Guțul "works for a criminal group."
MPs Argue President's Actions Are Unconstitutional
The five MPs include Petru Jardan, Marina Tauber, Denis Ulanov, Vadim Fotescu, and Reghina Apostolova. They requested the Constitutional Court to verify the constitutionality of President Maia Sandu's refusal. The MPs claim it's been over 8 months since Evghenia Guțul was elected leader of Gagauzia, and that the arguments invoked by authorities in Chișinău are unfounded and contrary to the law.
Background
The Comrat Court of Appeal validated the mandate of Evghenia Guțul as leader of Gagauzia on May 22, 2023.
