12 judges leave Balti Court of Appeal: resignation requests on the agenda of SCM
As many as 15 judges from the Balti, Cahul and Comrat Courts of Appeal have decided to leave their positions after they were notified on November 7 about the start of the vetting procedure. The resignation requests have already been submitted and are to be examined at the meeting of the Superior Council of Magistracy (CSM) scheduled for Monday, December 2.
The list published by the SCM includes 12 magistrates from the Balti Court of Appeal, including interim vice-presidents Adriana Garbuz and Gheorghe Scutelnic, the interim president and a judge from the Cahul Court of Appeal and a judge from the Comrat Court of Appeal.
We remind you that the Vetting Commission notified on November 7 all judges from the Balti, Cahul and Comrat Courts of Appeal about the start of the evaluation of their financial and ethical integrity. In all, 15 judges from the Bălți Court of Appeal, 4 from the Cahul Court of Appeal and 4 from the Comrat Court of Appeal received the first documents from the Commission for initiating the evaluation.
Under the legislation, vetting is mandatory for all judges of the Courts of Appeal. The lack of a reasonable justification for the refusal to submit the statements or the questionnaire is the basis for the Commission to determine that the evaluation is not promoted. The consequence in case of non-promotion is dismissal from office, with the deprivation of the right to continue to be a judge or to exercise a public office for 5-7 years.
