Soroca magistrate's return to bench denied amid DUI and conduct allegations
The Superior Council of Magistracy (CSM) has rejected an appeal by Judge Ghenadie Tocaiuc to resume his duties at the Soroca Court. The magistrate remains suspended as he faces a criminal investigation for driving under the influence (DUI).

The CSM declared Tocaiuc's request inadmissible during its recent session. The judge had sought to overturn the initial decision that authorized his criminal prosecution and subsequent removal from the bench.
The investigation stems from an incident where Tocaiuc and three colleagues allegedly incited a public disturbance at a gas station in Soroca. Media reports and footage suggest the magistrate was intoxicated while operating a vehicle.
Under Moldovan law, a DUI conviction carries penalties ranging from criminal fines and unpaid community service to potential imprisonment. Tocaiuc has officially denied all allegations of wrongdoing.

"On December 19, Judge Ghenadie Tocaiuc filed a preliminary request to annul the Council's decision regarding the referral from Interim Prosecutor General Alexandru Machidon," stated CSM member Ion Guzun. He recommended the request be dismissed as inadmissible.
Tocaiuc’s career has faced previous scrutiny. Before becoming a judge in 2018, he served as a prosecutor. In May 2023, authorities sought to investigate him for allegedly issuing a verdict in defiance of the law concerning the release of Adrian Nichifor, a known underworld figure. The CSM rejected that specific request at the time.
