Digital surveillance and policy shifts: The new reality for Romanians and Moldovans in the US

US authorities are enforcing immigration laws with unprecedented rigor, leaving many Moldovan and Romanian citizens in a state of legal uncertainty. Enhanced border controls and stricter adjudication of residency permits have made the "American Dream" increasingly difficult to attain for those without established status.

Immigration attorney Dana Bucin warns that individuals residing in the US without legal status are currently blocked from sponsoring close relatives. This restriction applies to both the Immigrant Visa Application (I-130) and employment-based Green Card paths.

Applicants processed through the Consulate in Chișinău are finding it nearly impossible to secure benefits if they have previously violated US stay conditions. These hurdles reflect a broader shift toward institutional rigidity in the American immigration system.

The risk of biometric detection

The US government now leverages advanced biometric databases and facial recognition technology to identify individuals with expired visas. This federal-level integration allows for the rapid tracking and detention of those who overstayed programs like "Work and Travel."

According to US Immigration and Customs Enforcement (ICE), detention figures have recently surpassed 68,000 individuals. A significant portion of this population has no criminal record, highlighting that simple status violations are now treated with maximum firmness.

Democratic progress complicates asylum claims

Paradoxically, the democratic consolidation and human rights improvements in Moldova and Romania have weakened the grounds for political asylum. US courts now view these nations as "safe," leading to harsher judgments for long-pending asylum cases.

Securing H-1B work visas or permanent residency has become a complex legal battle. Experts emphasize that early legal intervention is critical, as many migrants only seek counsel after they have already entered detention facilities.
