Alexander Tanase: After Ilan Șor was sentenced to 15 years in prison, he should remain without a mandate as a deputy

After the decision of the Chisinau Court of Appeal, which sentenced Ilan Șor to 15 years in prison, he must remain without a mandate as a deputy. The statement was made by the former president of the Constitutional Court, Alexandru Tănase, during a broadcast on ProTV.

He said this did not require a vote in Parliament.

"There is a 2016 ruling of the Constitutional Court, from which it is clear that if an MP is convicted definitively, the mandate of MP ceases by right without any formal conditions. It does not seem to me necessary for Parliament to take note of this. The CEC sends the documents to the Constitutional Court and the Court validates them. Extradition has nothing to do with a conviction, because the extradition procedure is formulated even at the stage of criminal proceedings. In order to recognise a Moldovan decision in a country with a functioning judicial system, such as the UK, Israel, it is necessary that these decisions are coherently argued", said Alexandru Tanase.

Last week, fugitive MP Ilan Șor was sentenced to 15 years in prison in the "bank fraud" case by a ruling of the Chisinau Court of Appeal.

By the same decision, the Chisinau Court of Appeal deprived him of the right to hold office in the banking system for five years and ordered the sum of 5.2 billion lei to be recovered from the politician.

Ilan Șor says this decision is illegal and his lawyers have said they will appeal the ruling to the Supreme Court of Justice.
