Approved by the Government: the mechanism for the selection and evaluation of prosecutors will be improved
The mechanism for the selection, evaluation and disciplinary liability of prosecutors will be improved, according to a draft law approved at a government meeting. Among the amendments to the Law on Public Prosecution is also an increase in the number of inspectors from six to nine to make the examination of prosecutorial misconduct more efficient.
At the same time, the term of office of the president of the High Council of Prosecutors will be reduced from four to two years, said Justice Minister Veronica Mihailov-Moraru.
"The draft proposes transferring the inspection of prosecutors under the General Prosecutor's Office to the Superior Council of Prosecutors. With the proposed amendment, the inspectorate is granted the functional autonomy it needs to independently examine complaints about disciplinary offences by prosecutors. It will complete the law with a broader list of disciplinary offences and increase the statute of limitations for disciplinary liability, strengthening the independence of the PSC as the constitutional guarantor of the independence and integrity of prosecutors. It is about revising the composition of the PSC and adjusting it to GRECO recommendations", said Veronica Mihailov-Moraru.
The draft, which was prepared in view of the implementation of the Strategy on Ensuring the Integrity of the Justice Sector, also contains a number of transitional provisions on ensuring the effective migration of the Inspectorate from the PG to the PSC, as well as clarifications on the entry into force of the law.
