Opinions: Resolution adopted by the People's Assembly of Gagauzia has no legal force

The resolution adopted last night by the People's Assembly of Gagauzia supporting the decision of the region's Electoral Council to nominate the candidate of the Sor Party, Evgenia Gutul, for the post of Bashkan, has no legal force and the election is unconstitutional, experts say. At the same time, a representative of the Comrat People's Assembly told Radio Moldova that the resolution is a political one, in support of the employees of the Regional Electoral Council.

The resolution adopted last night by the Comrat People's Assembly has no legal force, and the ballot for the election of Gagauzia's Bashkan is unconstitutional, as the national legislation was not respected, constitutional expert Alexandru Arseni told Radio Moldova.

"This election is absolutely unconstitutional, from the beginning, including with the statements made yesterday. Elections do not fall within their competence. There is a clear demarcation established in the Constitution of the Republic of Moldova, in the Electoral Code," said Alexandru Arseni.

The Kremlin is counting on the Gagauz Autonomy as a hotbed of destabilisation and influence on Moldovan politics, Oazu Nantoi, a member of the Parliament's Security Committee, told our radio station. The MP also claims that although several candidates for the position of Bashkan have spoken publicly about the corruption of voters, none has filed a complaint with the regional authority.

"Those candidates, who did not pass the second round, loudly accuse that the Șor Party "flooded" the Gagauz Autonomy with money, that voters were bought, but at the same time they did not file any complaint to the electoral commission of the region, which according to the 1994 law did not react to any warning from the Central Electoral Commission of the Republic of Moldova, which drew attention to multiple violations in the process of financing the electoral campaign," the MP said.

The resolution adopted by the People's Assembly of Gagauzia is a political one and was taken in support of the employees of the Comrat Electoral Council, the deputy chairman of the autonomy's People's Assembly, Alexandr Tarnavschi, told our radio station.

"It is a political document, a political support, and the main message is that we want to protect ordinary employees who have performed electoral functions, who are not guilty of the fact that the Electoral Code of Gagauzia does not correspond to the Electoral Code of the Republic of Moldova. Yes, we wanted to stress the human factor and say that people have nothing to do with this. Such problems should be solved by politicians, and justice should have the last word, we live in a state under the rule of law, a democratic state," Tarnavschi said.

Yesterday, NAC officers raided the headquarters of the Comrat Electoral Council and the Comrat Court, where they collected the electoral lists from the election of the Bashkan. The NAC said that the actions took place in the context of a reasonable suspicion that the electoral lists contained persons who were abroad at the time of the elections, as well as deceased persons.

Subsequently, the deputies of the People's Assembly of Gagauzia adopted a resolution supporting the decision of the Central Electoral Commission in Comrat to validate the elections, after which the candidate of the "ȘOR" party, Evghenia Guțul, was declared the winner.
