Expert: A new Prosecutor General might be appointed soon

With the publication in the Official Gazette of the Decree on Alexandru Stoianoglo’s dismissal, it is possible to appoint a new general prosecutor, experts claim. The procrastination of the files on this case in the national courts led to the issuance of the decree by the presidential institution, explain the members of the Superior Council of the Magistracy. On the other hand, the lawyers of the ex-Prosecutor General said that the Decree is illegal and will be challenged.

As of today, the position of Prosecutor General is vacant, and with the publication in the Official Gazette of the Presidential Decree, it is possible to appoint a new Prosecutor General soon. However, some explanations are needed regarding the issuance of the decree, according to Promo-Lex expert Vadim Vieru.

"I cannot assess the legality of this decree, but I am confident that Mr. Stoianoglo's lawyers will go to court and the court will already assess all the circumstances regarding the legality of this Decree. The only question I have is why this Decree was issued only now. At the level of the Presidency, there should be a public communication and it should be explained, why now, so that there is no room for interpretation on the part of the citizens. As of today, the position of general prosecutor is vacant, and soon we can expect the appointment of a new general prosecutor, claims the expert.

An important position in the state, such as that of the Prosecutor General, which is occupied by interims for two years, would be a serious reason to make such a decision, said the member of the Superior Council of Magistracy, Ion Guzun, on the Rezoomat show from RLIVE .

"Why wait for the ECHR's decision on this case. It is a decision of the CSP, it is the report of the commission that evaluated the activity of the general prosecutor Stoianoglo, at that time. The president has probably been waiting for two years for decisions to be made in this regard, and the time has probably come. For two years, we have had an important position in the state, which is not filled", said Ion Guzun.

The presidential decree regarding the release of Alexandr Stoianoglo from the position of general prosecutor was signed yesterday by the head of state Maia Sandu. The decision to dismiss the former Prosecutor General was taken on the basis of the decision of the Superior Council of Prosecutors, dated May 23, 2022, but also in the context of the recommendations of the European Union to ensure the fulfillment of the position of Prosecutor General and the obligations of the Republic of Moldova to fulfill the conditions of the justice system, informs the presidential institution.

Alexandr Stoianoglo's lawyers consider the decree illegal and mentioned to our radio station that they will challenge it in court.

We remind you that, on October 5, 2021, the ex-prosecutor general was detained for 72 hours, and upon the expiration of the mandate, he was placed under house arrest, later under judicial control, then he was suspended from office. The interim was provided by Dumitru Robu for one year. Currently, this position is exercised by the anti-corruption prosecutor Ion Munteanu.

The former Prosecutor General Alexandr Stoianoglo is accused in several cases, including for false statements, passive corruption and abuse of office because he allegedly helped the controversial businessman Veaceslav Platon to be released from detention, the latter being irrevocably sentenced to 18 years in prison.
